Terms of Service

These Terms of Service are the agreement between you and Gurt Inc. for using the Gurt app for iPhone, the Gurt app for Android, and this website. Please read them, especially section 10 about allergies and AI. They replace the version of October 23, 2026.

1. About these Terms

1.1 These Terms are an agreement between you and Gurt Inc., a Delaware corporation ("Gurt", "we", "us"). Its team works from Australia and other countries. These Terms cover the Gurt app for iPhone, the Gurt app for Android, the website www.gurtai.app, and everything they offer (together, "Gurt").

1.2 You accept these Terms when you create a Gurt account, or when you tap a button in the app that says you agree. If you do not agree, do not create an account or use Gurt.

1.3 Our Privacy Policy explains what we collect and why. It is not part of this agreement, and reading it is not the same as giving consent: where we need your consent for something (for example to use your allergies), the app asks you for it separately, and you can withdraw it.

1.4 If you got Gurt from the Apple App Store or Google Play, your agreement is with us, not with Apple or Google. Section 21 sets out terms that Apple and Google require.

2. The short version

3. Who can use Gurt

3.1 Age. You must be at least 18 years old. If the law where you live sets a higher age for using a service like Gurt or for agreeing to these Terms, you must meet that age.

3.2 Where you are. You may use Gurt only where the App Store, Google Play or this website offers it. You must not use Gurt from a country or region under comprehensive sanctions.

3.3 One person, one account. Give true details, keep only one account, and do not create an account for someone else or to get around a block, a limit or a rule in these Terms.

4. Your account

4.1 Keep your sign-in details private. You are responsible for what happens in your account unless it happens because of something we did wrong, or because someone else got in without any fault of yours.

4.2 Tell us at support@gurtai.app straight away if you think someone else has used your account.

4.3 If you sign in with Google, Google's terms also apply to that sign-in.

4.4 You can delete your account at any time in the app (Me, then Settings, then Delete account). If you cannot sign in, www.gurtai.app/delete-account explains how to ask us. The Privacy Policy (section 12) says what is deleted and what is kept.

5. The free plan, Pro, and AI limits

5.1 Free plan. Anyone can use Gurt for free, with the features shown in the app.

5.2 Pro. On iPhone you can buy Pro (the iPhone app may call it "Premium"). Pro adds features to the app; what it includes is listed on the purchase screen before you buy. The Android app sells nothing at present.

5.3 AI limits. Every account, including accounts with Pro, has limits on how many AI requests (recipes, fridge scans, calorie estimates, Ask Gurt answers) it can make in a day or a week. We set these limits so Gurt stays fast and affordable, and we may change them. When you reach a limit, Gurt does not make more of that kind of request until the limit resets. We will not lower the limits for Pro during a period you have already paid for, unless we must to keep Gurt secure or working; if we do, section 14 applies.

5.4 Changes to features. We improve Gurt and sometimes change or remove features. If a change takes away something that was a main reason you paid for Pro, during a period you have paid for, tell us and section 14 applies.

6. Recipes you write: who can see them

6.1 Android app. On the free plan, every recipe you write yourself is public. Anyone can see it, even without a Gurt account, with your display name, username and profile photo (if your profile is private, only people you approved can see it), and anyone with its photo's exact web address can open the photo. The app tells you this before you publish. If your account has Pro, you choose for each recipe whether it is private (only you) or public. If Pro ends, recipes you made private stay private.

6.2 iPhone app. When you write a recipe you choose whether to share it to the gallery. It is private unless you share it.

6.3 You can delete any recipe you wrote at any time. Deleting it removes it from Gurt; people who already saw it may remember it or have written it down, and we cannot control that.

6.4 Do not put anything in a public recipe that you would not want strangers to see, such as your address, a child's name, or someone else's photo.

6.5 Recipes that Gurt's AI writes for you are not "recipes you write". Section 9.5 explains how we may keep and show them.

7. Paying for Pro

7.1 iPhone: subscriptions through Apple

(a) Pro on iPhone is an auto-renewing subscription sold by Apple. The plans, their length and the price in your currency are shown on the purchase screen before you buy. Apple charges your Apple Account when you confirm.

(b) It renews automatically for the same length at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Apple charges the renewal within the 24 hours before the period ends.

(c) To cancel: on your iPhone open Settings, tap your name, then Subscriptions, choose Gurt and tap Cancel Subscription. Deleting the app or your Gurt account does not cancel an Apple subscription.

(d) When you cancel, Pro continues until the end of the period you have paid for, then stops.

(e) Free trials and introductory prices. If the purchase screen offers a free trial or a lower first price, it says how long it lasts and what you will be charged after it. A free trial turns into a paid subscription automatically unless you cancel at least 24 hours before it ends.

(f) Offer codes are redeemed through Apple's own screen and follow the terms shown there.

7.2 Android: Google Play. The Android app sells nothing at present: there is no subscription, no in-app purchase and nothing to pay for. If we start selling Pro on Android it will be sold through Google Play, and we will update these Terms before it is offered.

7.3 This website sells nothing.

7.4 Refunds

(a) Payments for Pro on iPhone are taken by Apple, so refunds are decided and paid by Apple. Ask Apple at reportaproblem.apple.com.

(b) We do not give refunds for part of a period because you changed your mind or stopped using Gurt, except where the law says you are entitled to one (section 14). If something has gone wrong with Gurt that we should fix, write to us at support@gurtai.app even if Apple has said no: we will look at it and, where you are entitled to a remedy, provide one (for example extra Pro time, or helping you ask Apple for a refund).

(c) If you live in the European Union or the United Kingdom, you may have a right to withdraw from a purchase within 14 days. For App Store purchases Apple handles this under its own terms.

7.5 Price changes. We may change Pro prices. A new price applies only from your next renewal after the change. Apple tells you before a price rise takes effect and, where required, asks you to agree; if you do not agree, the subscription ends at the end of the current period.

7.6 Taxes. Prices shown on the purchase screen include any GST, VAT or sales tax that Apple must collect where you live.

8. Invite rewards

You can share Gurt with friends from the app. Gurt does not give rewards for invitations at present. If we offer invite rewards in the future, the app will describe the reward and its conditions at the time, and those conditions will form part of these Terms. Rewards are never money, cannot be exchanged or transferred, and never turn into a paid subscription.

9. Your content

9.1 What is yours stays yours. You own the recipes, photos, profile details and other things you add to Gurt ("your content").

9.2 The permission you give us. So that Gurt can work, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, resize, format, translate and display your content, and to let our service providers do these things for us, only to run, show and improve Gurt and, for public content only, to show it in Gurt's own promotion of Gurt (for example a screenshot of the gallery). For public content, the licence also lets other people using Gurt view it and save it to their own account.

9.3 When it ends. The licence ends for an item when you delete it or your account, except for copies other people saved before you deleted it, copies in backups until they expire, and where we must keep something by law or to deal with a report.

9.4 Moral rights. To the extent the law allows, you consent to us doing the things in 9.2 without naming you (for example when a recipe card shows only a title) and to formatting changes that do not change the meaning of your content.

9.5 Recipes Gurt's AI writes. Recipes, answers and estimates that Gurt's AI makes for you are provided for your use. We may also keep AI-written recipes, with nothing that identifies you, in a shared recipe library and show them to other people, as our Privacy Policy (section 7.6) describes.

9.6 Your promises. You promise that you have the right to add your content, that it does not break these Terms or the law, and that anyone shown in a photo you add agreed to it.

9.7 Feedback. If you send us ideas, we may use them without paying you.

10. AI, allergies, health and calories

Please read this section. It is about your health.

10.1 What Gurt's AI is. Gurt uses an AI service from Anthropic to read photos, list ingredients, write recipes, estimate calories and answer questions. AI can be wrong: it can miss or misname an ingredient, invent an amount, get a cooking time or temperature wrong, or say something that sounds certain and is not.

10.2 Allergies and diets. If you tell Gurt your allergies and diet, we ask the AI to leave those foods out, and our own check then reads every AI recipe and every Ask Gurt answer and removes or replaces any that names one of your allergens. In the Android app, a recipe also says when it was not checked for something you saved. This lowers the risk; it cannot remove it. In particular:

Always read every ingredient, and the label of every product you use, before you cook or eat. If you have a serious allergy, never rely on Gurt alone.

10.3 Calories and nutrition. Calorie, protein, carbohydrate and fat numbers, and estimates from a photo of a meal, are rough estimates. They can be wrong by a large amount. Do not use them for medical treatment, for managing diabetes or any other condition, or where accuracy matters to your health.

10.4 Not medical or dietary advice. Gurt is not a doctor, dietitian, nutritionist or allergist, and it is not a medical device. Nothing in Gurt diagnoses, treats or prevents any condition. If you are pregnant, have a medical condition, take medication, have or have had an eating disorder, or are changing your diet for your health, talk to a qualified health professional first.

10.5 Food handling. Check that food is fresh, stored properly and cooked through, using a food thermometer where it matters. A fridge scan can misread items or dates; Gurt never guesses a use-by date for you.

10.6 In an emergency (a fire, a burn, an allergic reaction, poisoning) call your local emergency number (000 in Australia, 911 in the United States and Canada, 112 in Europe) and do not wait for the app.

10.7 This section does not limit our responsibility where the law does not allow it to be limited (section 14).

11. Community rules and moderation

11.1 Do not post or send anything that:

11.2 Do not misuse Gurt. Do not scrape or copy Gurt in bulk; get around limits, blocks or payment; reverse engineer the app except where the law allows; overload or attack our systems; use Gurt to build a competing dataset or AI model; or make accounts automatically.

11.3 Report and block. You can report a recipe or an AI answer in the app (in the Android app, also a person), and block anyone. You can also write to support@gurtai.app.

11.4 What we do. A person at Gurt looks at reports and acts on them. We may remove or hide content, limit a feature, or suspend or close an account that breaks these rules. When we act on your content or account we will tell you what we did and why, unless the law stops us or telling you would put someone at risk. If you think we got it wrong, reply to that message or write to support@gurtai.app within 6 months and a person will look at it again.

11.5 We do not check everything before it appears. Content from other people is theirs, not ours, but we act on it when we know about a problem.

12. Gurt's app and content

12.1 We, or the people who license to us, own the Gurt name, logo, mascot, apps, website, built-in recipes and designs. We give you a personal, non-exclusive, non-transferable licence to use the app on devices you own or control, for your own non-commercial use, under these Terms and the app store's rules.

12.2 Built-in recipes and photos in Gurt are for your personal use. Ask us before using them anywhere else.

13. Ending your account

13.1 You can stop using Gurt and delete your account at any time (section 4.4). Cancel any Apple subscription separately (section 7.1(c)).

13.2 We may suspend or close your account, or remove your access to a feature, if:

13.3 Where it is reasonable, we will warn you first and give you a chance to fix things. If we stop offering Gurt, we will give at least 30 days' notice. If we close your account for a reason that is not your fault while you have paid Pro time left, you are entitled to a refund or another remedy for the unused part (section 7.4(b)).

13.4 What happens to your information when an account ends is in the Privacy Policy (section 12).

14. Your rights under consumer law

14.1 Australia. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

14.2 Everywhere. Nothing in these Terms excludes, restricts or changes any right or remedy you have under a law that cannot lawfully be excluded, restricted or changed, including the Australian Consumer Law, the New Zealand Consumer Guarantees Act 1993, and the consumer laws of the European Union, the United Kingdom, the United States and the country you live in. If any part of these Terms would do that, it does not apply to you to that extent.

15. Our responsibility to you

15.1 Consumer guarantees first. Section 14 always applies, and nothing in this section limits it.

15.2 What we are responsible for. We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or of our failing to use reasonable care and skill. Loss is foreseeable if it was obvious it would happen, or if, when you agreed to these Terms, both of us knew it might happen.

15.3 What we are not responsible for, to the extent the law allows: loss caused by something outside our reasonable control; loss caused by not following section 10 (for example cooking a recipe without reading its ingredients); loss of business or profit (Gurt is for personal use); and content posted by other people, unless we failed to act on a report about it.

15.4 Limit. Except for liability that cannot be limited by law (including under the consumer guarantees, for death or personal injury caused by negligence, and for fraud), our total liability to you for all claims about Gurt is limited to the greater of what you paid for Pro in the 12 months before the claim and US$100.

16. Availability

We work to keep Gurt available and accurate, but it may sometimes be unavailable, slow or wrong, for example during maintenance or when a provider we rely on has a problem. This section is subject to sections 14 and 15.

17. If you break these Terms

If you break these Terms, or post content that breaks the law or someone's rights, and someone makes a claim against us because of it, you are responsible for the reasonable costs that result, to the extent the claim arises from what you did. This does not apply to the extent we caused the loss.

18. Disputes and the law that applies

18.1 Talk to us first. Write to support@gurtai.app. We will reply within 10 business days and try to fix the problem within 30 days.

18.2 The law. These Terms are governed by the law of the State of Delaware, United States. You can bring a claim in the courts of Delaware, or in the courts of the place where you live if the law there gives you that right. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and section 14 applies.

18.3 Free help. In Australia you can contact your state or territory consumer protection agency or the ACCC. For a privacy complaint, see the Privacy Policy (section 19).

18.4 There is no arbitration clause and no class-action waiver in these Terms.

19. Changes to these Terms

19.1 We may change these Terms to reflect changes to Gurt, the law, or how we run it.

19.2 Important changes (anything that takes away a right, adds a cost, changes who can see your content, or changes how your information is used): we will post the new version here at least 30 days before it takes effect and show a notice in the app where your version of the app can show one, except where a change is needed sooner by law or for safety. If you do not agree, you can stop using Gurt and delete your account, cancel any subscription, and, if the change takes away something you have paid for, section 7.4(b) applies.

19.3 Other changes (clearer wording, new features, things that do not affect you badly) take effect when we post them here with a new date.

19.4 Changes never apply to something that happened before they took effect.

21. Terms Apple and Google require

21.1 If you use Gurt on iPhone, you and we agree that:

21.2 If you use Gurt on Android, these Terms are between you and us only. Google is not responsible for the app or its content, and Google Play's terms of service also apply to your use of Google Play.

22. General

22.1 Whole agreement. These Terms, and any extra terms shown when you buy something, are the whole agreement between you and us about Gurt.

22.2 Transfer. We may transfer this agreement to a company that takes over Gurt, as long as your rights are not reduced; we will tell you. You may not transfer it.

22.3 If a part is invalid, the rest stays in force.

22.4 No waiver. If we do not enforce a term straight away, we can still enforce it later.

22.5 Language. These Terms are written in English. If we provide a translation and they differ, the English version applies to the extent the law where you live allows.

22.6 Notices. We send notices to you in the app or by email to the address on your account. Send notices to us at support@gurtai.app.

23. Country-specific terms

23.1 European Union, EEA and Switzerland. You have the legal guarantee that digital content and services conform to the contract, and the rights in section 14.2. For App Store purchases Apple is the seller and handles the 14-day right of withdrawal under its own terms; if you ask for Pro to start straight away, you may lose that right once Pro has started, as Apple's purchase screen explains. Our single point of contact for users and authorities is support@gurtai.app, in English. You can report illegal content as section 11.3 describes; we will tell you what we decided and why, and you may challenge it as section 11.4 describes, before a certified out-of-court dispute settlement body, or in court.

23.2 United Kingdom. You have the rights the Consumer Rights Act 2015 gives you for digital content and services, including repair or replacement and, in some cases, a price reduction or refund. Nothing in these Terms limits them.

23.3 New Zealand. If you use Gurt as a consumer, the Consumer Guarantees Act 1993 applies and nothing in these Terms limits it; the Fair Trading Act 1986 also applies.

23.4 United States.

23.5 Canada. If you are in Quebec, the Consumer Protection Act (Quebec) applies, and no clause of these Terms that the Act prohibits (for example a clause excluding the court's jurisdiction or limiting liability for our own acts) applies to you.

23.6 Brazil. The Consumer Defence Code (Law 8.078/1990) applies. Purchases made away from a shop may be withdrawn within 7 days (article 49); for App Store purchases, ask Apple, which takes the payment, and we will help. Brazilian courts in your home town have jurisdiction where the Code gives it.

23.7 Mexico. The Federal Consumer Protection Law applies to Mexican consumers.

23.8 Other countries. If you live anywhere else, any mandatory consumer law of your country applies, and section 14.2 applies.
